The meeting was called to order by Mayor Reynolds at 7:30 P.M.

Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.

 

There was a moment of silence and salute to the flag.

 

At this time Mayor Reynolds calls for a brief executive session.

 

Executive Session

 

Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and

 

            Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of attorney client privileged information; and

 

            Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour,  4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.

RESOLUTION AUTHORIZING APPROPRIATION TRANSFER

 

            WHEREAS, N.J.S.A. 40A: 4-58 provides that during the last 2 months of the fiscal year, to expend for any of the purposes specified in the budget an amount in excess of the respective sums appropriated therefore and there shall be an excess in any appropriation over and above the amount deemed to be necessary to fulfill the purpose of such appropriation.

 

            NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that the transfers in the amount of $2,500.00 be made in the 2010 budget as attached.

RESOLUTION NO. 2010-184

 

RESOLUTION CANCELING NJ DIVISION OF HIGHWAY

TRAFFIC SAFETY GRANT RECEIVABLE AND RESERVE BALANCES

 

            WHEREAS, a receivable balance of $1,150.00 entitled NJ Division of Highway Traffic Safety Grant Over the Limit Under Arrest 2010 Statewide Crackdown Program which remains on the Grant Fund balance sheet has been completed on October 12, 2010; and

 

            WHEREAS, it is necessary to formally cancel the receivable balance and it’s offsetting appropriation reserve balance from the balance sheet;

 

            NOW THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Englishtown, that the following unexpended and dedicated balances be canceled:

RESOLUTION NO. 2010-185

 

AUTHORIZING CANCELLATION OF

WATER/SEWER BALANCES OF LESS THAN $2.99

 

WHEREAS, it is necessary during the year for the Tax Collector and Chief Financial Officer to cancel miniscule balance amounts, refunds and interest charges of less than $2.99; and

 

WHEREAS, the Tax Collector and Chief Financial Officer have advised that it would be appropriate for the Borough Council to authorize the cancellation of said water and sewer accounts with a balance of less than $2.99; and

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, that the Tax Collector and Chief Financial Officer are hereby authorized to process the cancellations of water and sewer balances of less than $2.99 as of November 10, 2010.

 

BE IT FURTHER RESOLVED, that a copy of this Resolution be forwarded to the Collector of Taxes and Chief Financial Officer of the Borough of Englishtown.

RESOLUTION NO. 2010-186

 

RESOLUTION AWARDING A CONTRACT FOR SANFORD PARK TREE REMOVAL, STUMP GRINDING OR STUMP HERBICIDE TREATMENT AND TREE PRUNNING

 

            WHEREAS, the Borough of Englishtown advertised for quotes, and received the quotes on June 30, 2010 at Noon, in the Borough’s offices, for the Project; and

 

            WHEREAS, the Borough of Englishtown has received a 2009 Business Stimulus Fund Grant under the Forestry Program for $7,000.00; and

 

            WHEREAS, Chestnut Arboricultural & Forestry Service of Old Bridge New Jersey determined to be the lowest responsible bidder after careful review of all of the bids submitted, with a low bid of $7,930.00; and

 

            WHEREAS, Chestnut Arboricultural & Forestry Services LLC., has granted the Borough an extension of time to award the contract which will be conditioned upon the Borough Attorney’s review and approval of said contract.

 

            NOW THEREFORE BE IT RESOLVED, that the Borough of Englishtown, Mayor and Council awards a contract to Chestnut Arboricultural & Forestry Services, LLC, Old Bridge, New Jersey 08857, for the Sanford Park Tree Removal, Stump Grinding or Stump Herbicide Treatment and Tree Pruning.

 

            BE IT FURTHER RESOLVED, that the Clerk’s Office is authorized to forward a copy of this Resolution to the Borough Attorney, Chestnut Arboricultural & Forestry Services, LLC., and the Borough’s Chief Financial Officer.

RESOLUTION AWARDING A CONTRACT FOR RECONSTRUCTION OF VICTORY, LAKESIDE, WEAMACONK, AND TERRACE DRIVE,

                                                                                                                     

            WHEREAS, Englishtown Borough has received a grant from the NJDOT Trust Fund in the amount of $250,000.00 for the project known as Reconstruction of Victory, Lakeside, Weamaconk, and Terrace Drive; and

 

            WHEREAS, the Borough advertised for bids, and received proposals on October 22, 2010 at 10:00 AM, in the Borough’s offices, for the Project; and

 

            WHEREAS, F & P Contractors Inc., of South Amboy, New Jersey is determined to be the lowest responsible bidder after careful review of all of the bids submitted, with a low bid of $379,726.00 with regular curbing; and

 

             NOW THEREFORE BE IT RESOLVED, that the Borough Council awards a contract to F & P Contractors Inc., South Amboy, New Jersey, in the amount of $379,726.00, the total bid, for the reconstruction of Victory, Lakeside, Weamaconk, and Terrace Drive.

 

            BE IT FURTHER RESOLVED, that the award of the contract is conditioned upon the Borough Attorney’s review and approval of the bid documents and contract, NJDOT approval and certification by the Borough’s Chief Financial Officer of the availability of funds for this project.

 

            BE IT FURTHER RESOLVED, that the Clerk’s Office is authorized to forward a copy of this Resolution to the Borough Attorney, the Borough Engineer, F & P Contractors Inc., and the Borough’s Chief Financial Officer.

            WHEREAS, after due consideration of the said requisitions, the Mayor and Council have approved processing of same.

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:

            WHEREAS, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and

 

            WHEREAS, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.

 

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:

  

            1.   The said approved vouchers amounting to the sum of $252,021.82 are hereby authorized to be paid on November 10, 2010.

            WHEREAS, the Borough of Englishtown Council requires that purchases and services over $800.00 or more be pre-approved by the Governing Body except in the case of imminent emergency situation; and

 

            WHEREAS, the following itemized request(s) were submitted to the Chief Financial Officer by the respective Committee Chairperson(s) for Council approval; and

 

            WHEREAS, the Chief Financial Officer certifies that appropriate funds are available for the following:

BOROUGH OF ENGLISHTOWN

RESOLUTION NO. 2010-191

 

RESOLUTION OF THE MAYOR AND COUNCIL OF

THE BOROUGH OF ENGLISHTOWN DIRECTING THE

TERMINATION OF TAPE RECORDED MINUTES OF

BOROUGH COUNCIL MEETINGS

 

WHEREAS; N.J.S.A. 10:4-14  provides, in relevant part, as follows: “Each public body shall keep reasonably comprehensible minutes of all its meetings showing the time and place, the members present, the subject considered, the actions taken, the vote of each member, and any other information required to be shown in the minutes by law…”; and

 

WHEREAS; The term “reasonably comprehensible”  has been defined by New Jersey Courts as meaning what took place at a meeting and what final action was taken by the public body; and

 

WHEREAS; Neither the “Open Public Meetings Act” nor the “Open Public Records Act” require stenographic verbatim transcriptions of public body meetings to be prepared nor does New Jersey law require tape recording or electronic recordation of public body meetings; and

 

WHEREAS; N.J.S.A. 40A:9-133.e. mandates that the municipal clerk is the municipal official charged with the responsibility of keeping and preparing minutes of all Borough meetings and requires the clerk to “…keep a journal of the proceedings of every meeting…”; and

 

WHEREAS; It has been the practice of the Borough Clerk to tape record Borough Council meetings and to use said tape recordings as a memory aid for the purpose of preparing minutes of meetings; and

 

WHEREAS; It is the considered opinion of the Mayor and Council of the Borough of Englishtown that the practice of tape recording Borough Council meetings and utilizing those tapes to prepare minutes which contain paraphrases of discussions and statements uttered at public meetings has generated controversy, is misleading and is not legally required;

 

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Mayor and Council of the Borough of Englishtown that the electronic recordation of Borough Council meetings shall be terminated immediately.

  

BE IT FURTHER RESOLVED that Borough minutes shall strictly conform to the requirements of the above referenced statutory citations and that the practice of paraphrasing comments and statements made at public meetings and including them in the minutes of public meetings shall be discontinued immediately.

            Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour,  4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.
