The meeting was called to order by Mayor Reynolds at 7:32 P.M.

Also present were Peter Gorbatuk, Municipal Clerk and Joseph Youssouf, Borough Attorney.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.
There was a moment of silence and salute to the flag.
There being no corrections, deletions or additions, a motion to approve the Minutes of March 24, 2010 was offered by C/Carr and seconded by C/Robilotti. Passed on the following roll call:

Councilwoman Krawiec reports:
· NJ DEP performed regulatory testing in our water system and sanitary sewer. There were no findings.
· Elon update – getting ready to install pipes and get ready for service. This will improve the flow of water from Lasatta Avenue and that end of town.
· Resident complaint regarding mold underneath the W. Dey Street water tower. Per Jim Mastrokalos, Water Superintendent this will cost approximately $1,000.00 to clean and he doesn’t recommend it at this time due to our budget constraints. It does not affect the quality of the water since it is on the outside of the tank. The mold is due to the shade the tower receives on the north side.
· Water quality reports were completed. They should be in the mail by July 1st.
· Previously received bids for sidewalk repairs due to water main breaks. The lowest bidder was unresponsive so on tonight’s agenda is another resolution to award the contract to the second lowest bidder.
Councilwoman Cooke is absent nothing is reported.
Administration, Finance & Personnel
Councilwoman Robilotti reports:
· Police Activity Report is not available this evening. The person who did the report did not educate the others in the department how the report was created. The department is in the process of figuring it out.
· Asked Court Administrator for the ticket total and dollar amount the special officers have brought into the Borough since hired. The tickets issued have been mainly for people coming through town on the weekends to attend an event at Raceway Park or the auction. To date Ptl. Zapora wrote a total of 215 tickets totaling $22,610.00 and Ptl. Accatatta wrote a total of 190 tickets totaling $16,814.00.
· Applied for a grant for “Over the Limit, Under Arrest”. This is a $4,400.00 grant, which will cover the overtime incurred to set up DWI checkpoints.
· On June 4th, attended a meeting in Trenton with Brent Shuntler, Head of Education along with Mayors from Manalapan and Howell to discuss our concerns with the school budgets. If the Board of Education appeals our decision, it would be before him and we wanted him to hear our concerns and reasons prior.
· On June 12th, attended State Trooper Castallano’s funeral. Extends her sincere condolence to the family.
· Attended the Police Expo in Atlantic City. Was very educational. Trying to bring our police department up to the 21st century in regards to weapons and other necessities. Spoke to many vendors.
Councilwoman Carr reports:
· Along with the Borough Engineer and Nick Campanella, looking into other possible locations for the solar panels. One location is a privately owned property. Mr. Campanella is in the process of contacting them.
· Met with the marketing director for the new bank in town. He is interested in a basic introduction to the municipality and the borough businesses of which I offered my help. Will be setting up a meeting with him and Laurie Finger. They will be opening within the first two weeks of July.
Councilman Rucker reports:
· DPW report given out to council; any questions? None voiced.
· In dire need of replacing the water plant roof and the flat portion of the municipal building.
Mayor Reynolds states his concern is that Maser Consulting is our engineer and they did a study for a development in Manalapan that will definitely have consequences on Englishtown.
Tom Herits, Borough Engineer states he wasn’t aware that Maser Consulting was even doing the report until the Borough notified him of this.
C/Carr addresses the Borough Engineer with her questions and concerns with the inconsistencies she has found in the report. C/Carr states, Maser Consulting has made the recommendation for the project to move forward, stating that overall the traffic from the Wood Avenue Apartments would not degrade the existing traffic levels on Wood Avenue or adjacent intersections and as a result supports the proposed residential development.
Tom Herits asks if Manalapan allowed a cross examination of their traffic report findings.
Tom Herits asked if the project has received County approval yet? The answer is no. It seems that Manalapan has bypassed normal procedure.
Mayor Reynolds asks Tom Herits to find out the status of this project on the County level.
Is this sight contaminated? Monmouth Petroleum was the prior occupant on this site. What were the County’s findings?
Mayor Reynolds thanks Tom Herits for attending tonight’s meeting.
· June 24th the Elm Group will be performing the well sampling
· Project Expeditors is awaiting their answer on their petition for a liquor license transfer from the State, so therefore they are not included on the resolution on tonight’s agenda authorizing 2010-2011 liquor license renewals.
Laurie Finger is absent nothing is reported.
Mayor Reynolds opens the floor to the public for discussion limited to agenda items only.

RESOLUTION NO. 2010-115
At this time a motion is made to table Resolution No. 2010-115 by C/Robilotti and seconded by C/Rucker. Passed unanimously.
BOROUGH OF ENGLISHTOWN
RESOLUTION NO. 2010-116
WHEREAS, Senate Bill 458 calls for a referendum to consolidate the municipal tax assessor, municipal tax collector, municipal health services and municipal animal control services at the county, and;
WHEREAS, Senate bill 458 does not give the municipality any option if the county voters cast a majority to consolidate, and;
WHEREAS, consolidation would cause unnecessary hardship on citizens who rely on the municipal tax office for information and assistance, particularly the community’s senior citizens who depend on tax offices for assistance in completing tax freeze and rebate forms. Without proper study there is no proof that consolidation will save any public money, and;
WHEREAS, Senate Bill 458 calls for a master plan for the consolidation of the tax assessment and tax collection functions after enactment of the proposal without giving the public the opportunity to review and comment on the proposed master plan, and;
WHEREAS, current state statutes place responsibility for tax assessment and tax collection under municipal jurisdiction, and;
WHEREAS, it is the municipalities responsibility to collect all property taxes due and distribute same to the other taxing authorities, as well as enforcing laws on delinquents, and;
WHEREAS, current statute provide for the reserve for uncollected taxes to be included in the municipal budget;
NOW, THEREFORE, BE IT RESOLVED, that the governing body of the Borough of Englishtown does hereby oppose the passage and enactment of Senate Bill 458.
BE IT FURTHER RESOLVED, that a certified copy of this resolution be sent to Governor Chris Christie, Senate President Stephen Sweeney, Assembly Speaker Sheila Oliver, the Tax Collectors and Treasurers Association of New Jersey (TCTANJ), and Senator Jennifer Beck representing this district as a sign of our opposition to this proposal.

RESOLUTION NO. 2010-117

WHEREAS, at the May 26, 2010 Council Meeting, Resolution No. 2010-096 was approved authorizing Madeira Concrete Inc., the lowest quote received, to perform sidewalk repair due to water main breaks on Water Street in the amount of $1500.00; and
WHEREAS, per James Mastrokalos, Water/Sewer Superintendent,
there has been no response from Madeira Concrete, Inc, therefore, the second lowest quote received will be awarded the concrete repair work.

WHEREAS, the Mayor and Council have carefully examined all requisitions presented to the Borough for the processing into purchase orders; and

AUTHORIZING THE PAYMENT OF BOROUGH BILLS
WHEREAS, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and
WHEREAS, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:

Executive Session
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and
Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of lawyer/client privileged material, personnel; and
Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour, 4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.

BOROUGH OF ENGLISHTOWN
RESOLUTION NO. 2010-115
WHEREAS, the current term for the municipal tax assessor is set to expire on June 30th and there is a need to appoint a Borough Of Englishtown Tax Assessor; and,
WHEREAS, it is the recommendation of the Finance, Personnel and Administration Committee that the current tax assessor Sharon Hartman be re- appointed to said position;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown as follows:
1. Sharon Hartman is hereby re-appointed as Tax Assessor of the Borough of Englishtown.
2. That said appointment is for the term of office pursuant to N.J.S.A. 40A9-148 for a four (4) year term expiring June 30, 2014.
3. Said employee shall be paid an annual salary in accordance with the Borough Salary Ordinance, payable semi-monthly.
4. That a certified true copy of this resolution will be supplied to Sharon Hartman and the Borough Chief Financial Officer.
