The meeting was called to order by Mayor Reynolds at 7:31 P.M.

Also present were Peter Gorbatuk, Municipal Clerk, Laurie Finger, Borough Administrator and Joseph Youssouf, Borough Attorney.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.
There was a moment of silence and salute to the flag.
Discussion takes place regarding a proposed Ordinance amending Chapter 2.121 entitled “Vehicles & Traffic” per the Police Chief’s recommendations, which prohibits the parking of large vehicles on Borough roads and establishes a designated truck route.
Mayor and Council approve the proposed draft. Mayor Reynolds adds the First Reading and Introduction of Ordinance No. 2009-13 to this evening’s agenda.
There being no corrections, deletions or additions, a motion to approve the Minutes of June 24, 2009 was offered by C/Robilotti and seconded by C/Cooke. Passed on the following roll call:

Councilwoman Leonardis has nothing to report this evening.
Councilwoman Cooke reports:
· Patriots Day Memorial Service will be held here at 7pm on 9/11.
Administration, Finance & Personnel
Councilwoman Robilotti reports:
· Police Activity Report from 8/24 – 9/6, total calls including motor vehicle stops is 214. Total motor vehicle stops, 67.
Councilwoman Carr reports:
· On 9/27, 1 – 5 p.m., The Village Inn will be having an anniversary celebration. Advance ticket cost is $10.00 or at the door the day of the event, will be $15.00.
Councilman Rucker has nothing to report this evening.
· On September 22nd the Monmouth County Health Dept. will be having an annual quorum @ 3439 Hwy 9, Freehold 7pm, to update residents of programs and services available to them. There will also be a question and answer session re: H1N1.
· Annual Flu Clinic at Borough Hall - September 17th 2-3 p.m. Cost is $20.00 unless eligible for no cost under Medicaid/Medicare.
· Asks Councils interest on placing “Elimination of State Mandates” Resolution on the next meetings agenda.
Consensus unanimous to place resolution on the next meetings agenda.
· Central Jersey Council of Governments Mtg September 21st at Bradley Beach Borough Hall – 701 Main Street, 7p.m.
C/Cooke asks if any response was received from the County re: making Wood Ave. a no passing zone and lowering speed limit.
Peter Gorbatuk responds that 2 letters went out approximately 3 days ago to Joe Ettiore County Engineer, 1 re: Wood Avenue and 1 for a pedestrian walk way across Main Street by Sanford Park. To date there has been no response.
Laurie Finger has nothing to report this evening.
Mayor Reynolds opened the floor to the public for questions or comments on the proposed 2009 Municipal Budget Amendments.
Laurie Finger states the amendments as follows:
· Changing our surplus from $476,750.00 to $446,000.00.
· The total municipal revenues went from $73,537.32 to $110,877.63.
· Total miscellaneous revenues increased from $428,949.41 to $466,289.72.
· Amount to be raised by taxation decreased a tiny bit from $959,931.67 to $953,056.74.
· That would mean a 3.7cent increase.
There being no questions or comments, a motion to close the public hearing was
offered by C/Rucker and seconded by C/Robilotti. Passed unanimously.

RESOLUTION NO. 2009-176
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that the Budget herein before set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorization of the amount of $953,056.74 to be raised for municipal purposes.

Laurie Finger states today we went before the Local Finance Board and were granted the CAP Waiver we applied for in the amount of $35,983.00, which allows us to adopt our budget this evening.
C/Carr asks if they reviewed our budget.
Laurie Finger responds yes and they are OK with it.
Mayor Reynolds states to C/Leonardis that the Local Finance Board also reviewed and discussed her letter and it is on the record.

RESOLUTION NO. 2009-177
COUNTY OF MONMOUTH, STATE OF NEW JERSEY
AUTHORIZING THE APPROVAL OF DEPARTMENT REQUISITIONS
WHEREAS, the Mayor and Council have carefully examined all requisitions presented to the Borough for the processing into purchase orders; and
WHEREAS, after due consideration of the said requisitions, the Mayor and Council have approved processing of same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:
1. The said approved requisitions amounting to the sum of $1,252.00
are hereby authorized to be processed into purchase orders on September 9, 2009.
2. The Borough Clerk is hereby directed to list on the page in the
Minutes Book following the minutes of this meeting all of the said requisitions hereby authorized to be processed into purchase orders.

RESOLUTION NO. 2009-178
COUNTY OF MONMOUTH, STATE OF NEW JERSEY
AUTHORIZING THE PAYMENT OF BOROUGH BILLS
WHEREAS, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and
WHEREAS, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:
1. The said approved vouchers amounting to the sum of $69,915.71
are hereby authorized to be paid on September 9, 2009.
2. The Borough Clerk is hereby directed to list on the page in the

Mayor Reynolds opens the floor to the public for discussion on anything they wish to bring to the attention to the governing body.
Kimberly Lawrence, 20 Oxford Court – victim of a hit and run on Oxford Court. Was told that due to the transition with the builders bond, they are not permitted to have a speed limit posted in the development and that it was up to the residents of Oxford Court to enforce a speed limit. Went to all the residents on Oxford Court and have a signed petition of 29 out of the 40 units (3 units are vacant, 7 were not home). We understand that it is private property but feel we should not feel victimized and unsafe in our own neighborhood. There are over 15 children under the age of 12 in this development that play outside in the street because there is no other place for them to play. Requesting a 15mph speed limit of which can be enforced by the Police Dept. If nothing is done this will happen again and next time it may be a child’s life.
Attorney Youssouf states if you look at every shopping center in the State of N.J. you see speed limit signs posted. The way that occurs is the owner of the property petitions the local government and cedes jurisdiction to the municipal entity, which is how traffic laws can be enforced in parking lots. Your condominium association needs to adopt a formal resolution requesting the Borough to assume jurisdiction, which will then adopt and enforce traffic regulations on that private property. You could also get speed bumps.
Kimberly Lawrence presented Mayor and Council the petition for their records.
C/Cooke recommends also getting speed bumps as a precautionary measure to slow down the traffic.
There being no further questions or comments, a motion to close the public portion was offered by C/Robilotti and seconded by C/Carr. Passed unanimously.
Executive Session
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and
Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of personnel and potential litigation; and
Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour, 4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.
