The meeting was called to order by Mayor Reynolds at 7:00 p.m.

Also present were Peter Gorbatuk, Municipal Clerk, Laurie Finger, Borough Administrator and Joseph Youssouf, Borough Attorney.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.
There was a moment of silence and salute to the flag.
Mayor Reynolds opens the floor to the public for discussion limited to agenda items only.
There being no questions or comments, a motion to close the public portion was offered by C/Carr and seconded by C/Rucker. Passed unanimously.

RESOLUTION NO. 2009-091
DEFERMENT OF 2009 SCHOOL TAXES AS PROMULGATED
BY THE DIVISION OF LOCAL GOVERNMENT SERVICES
WHEREAS, the Borough Council of the Borough of Englishtown, County of Monmouth, State of New Jersey desires to increase the 2009 deferred school taxes as promulgated by the Division of Local Government Services.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Englishtown, County of Monmouth, State of New Jersey to increase the 2009 deferred school taxes as follows:

WITH STATEMENTS OF REVENUES AND APPROPRIATIONS
WHICH SHALL CONSTITUTE THE LOCAL BUDGET FOR THE YEAR 2009
BE IT RESOLVED, that the following statements of revenues and appropriations shall constitute the Municipal budget for the year 2009.
BE IT FURTHER RESOLVED, that the said budget be published in The Asbury Park Press in the issue of April 28, 2009.
The Governing Body of the Borough of Englishtown does hereby approve the following as the budget for the year 2009:

Notice is hereby given that the Budget and Tax Resolution is approved by the Mayor

A hearing on the Budget and Tax Resolution will be held at 15 Main Street, Englishtown, NJ 07726 on May 13, 2009 at 7:30 p.m. at which time and place objections to said Budget and Tax Resolution for the year may be presented by taxpayers or other interested persons.

BOROUGH OF ENGLISHTOWN
RESOLUTION NO. 2009-093
RESOLUTION OF THE BOROUGH OF ENGLISHTOWN
MAKING APPLICATION TO THE LOCAL FINANCE BOARD FOR
A REDUCED PENSION CONTRIBUTION
PURSUANT TO N.J.S.A. 43:15A-24(c) AND/OR N.J.S.A. 43:16A-15(9)
WHEREAS, the Mayor and Council of the Borough of Englishtown in the Monmouth County desires to make application to the Local Finance Board for its approval of a reduced pension contribution pursuant for its Police and Fire Retirement System contribution pursuant to N.J.S.A. 43:15A-24(c) and its Public Employee Retirement System contribution pursuant to N.J.S.A. 43:16A-15(9) for certain normal and accrued liability contributions in the amount of:
· Police and Fire Retirement System in the amount of $ 38,272.50
· Public Employee Retirement System in the amount of $ 21,113.50; and,
WHEREAS, the Mayor and Council has made certain determinations concerning this application as required by statute and has completed the required Attachment that documents said determinations; and,
WHEREAS, the Mayor and Council determined that it needs to pay the reduced contribution and said determination is in the public interest; and,
1. the inability of the Mayor and Council to meet the cap without jeopardizing public safety, health, and welfare or jeopardizing the fiscal stability
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown in the County of Monmouth as follows:
Section 1. The reduced pension contribution Attachment, as attached hereto, is incorporated by reference into this Resolution as if contained fully within.
Section 2. The reduced pension contribution for PFRS in the amount of $38,272.50 and PERS in the amount of $21,113.50, pursuant to N.J.S.A. 43:15A-24(c) and N.J.S.A. 43:16A-15(9) et. seq. have been confirmed by the Chief Financial Officer and are the amounts deemed by the governing body for application to the Local Finance Board and as allowed by the New Jersey Division of Pension and Benefits.
Section 3. The application to the Local Finance Board is hereby approved, and the Chief Financial Officer, along with other representatives of the Mayor and Council are hereby authorized to submit such application and to represent the Borough of Englishtown in matters pertaining thereto.
Section 4. The Certification of the Chief Financial Officer of the Borough of Englishtown is incorporated into this Resolution as a certification of the truth and accuracy of the facts submitted in the application for pension deferral.
Section 5. The Clerk of the Borough of Englishtown is hereby directed to file a copy of this reduced pension contribution resolution as part of the application with the Local Finance Board.
Section 6. The Local Finance Board is hereby respectfully requested to consider such application and to record its findings, recommendations and/or approvals as provided by law.

RESOLUTION NO. 2009-094
RESOLUTION OF THE BOROUGH OF ENGLISHTOWN
MAKING APPLICATION TO THE LOCAL FINANCE BOARD
PURSUANT TO N.J.S.A. 40A:4-45.44 THROUGH 45.47
WHEREAS, the Mayor and Council of the Borough of Englishtown in the County of Monmouth desires to make application to the Local Finance Board for its approval of a proposed Tax Levy CAP waiver pursuant to N.J.S.A. 40A:4-45.44 through 45.47 and,
WHEREAS, the Mayor and Council believes that:
(a) it is in the public interest to accomplish such purpose; and,
(b) the Tax Levy CAP waiver is for the health, wealth, convenience or betterment of the inhabitants of the Borough of Englishtown; and,
(c) the proposal is an efficient and feasible means of providing services for the needs of the inhabitants of the Borough of Englishtown and will not create an undue financial burden to be placed upon the Borough of Englishtown;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown as follows:
Section 1. The application to the Local Finance Board is hereby approved, and the Chief Financial Officer, along with other representatives of the Borough of Englishtown are hereby authorized to prepare such application and to represent the Borough of Englishtown in matters pertaining thereto.
Section 2. The Municipal Clerk of the Borough of Englishtown is hereby directed to
file a copy of the proposed Tax Levy CAP waiver with the Local Finance Board as part of such application.
Section 3. The Local Finance Board is hereby respectfully requested to consider such application and to record its findings, recommendations and/or approvals as provided by the applicable New Jersey Statute.

RESOLUTION OF THE BOROUGH OF ENGLISHTOWN
REQUESTING DCA TO REVIEW 2009 MUNICIPAL BUDGET
WHEREAS, the Borough of Englishtown is eligible for self-examination of the 2009 Municipal Budget; and
WHEREAS, the Mayor and Council of the Borough of Englishtown in the County of Monmouth desires to make application to the Local Finance Board for its approval of a proposed Tax Levy CAP waiver pursuant to N.J.S.A. 40A:4-45.44 through 45.47; and
WHEREAS, the Mayor and Council of the Borough of Englishtown in the County of Monmouth desires to make application for Extraordinary Aid; and
WHEREAS, by applying for a Tax Levy Cap Waiver and Extraordinary Aid eliminates the eligibility for self-examination,
NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Englishtown hereby requests the State of New Jersey, Division of Local Government Services to review its 2009 Municipal Budget.
