Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.

Presentation by Mr. Eugene Farrell continues, followed by questions and comments from Mayor, Council and the public.

            Be It Ordained by the Governing Body of the Borough of Englishtown that the following sections be amended/supplemented as follows:

AN ORDINANCE AMENDING AND SUPPLEMENTING

CHAPTER 2.126 (WATER) OF THE

“CODE OF THE BOROUGH OF ENGLISHTOWN, NEW JERSEY”

 

            Be It Ordained by the Mayor and Council of the Borough of Englishtown, County of Monmouth and State of New Jersey, that the following section of Chapter 2.126 be amended and supplemented as follows:

 

1.  Section 2.126.07 (Installation fees), Subsection A of the “Code of the Borough of Englishtown, New Jersey” is hereby amended and supplemented to read as follows:

 

A.     Taps.  [Amended 3/14/85, Ord. 85-4; 2/25/87, Ord. 87-02]

 

(1)   For all taps on installations from the main to the curb stop made by   the Water Department, the owner shall be charged the following amounts, to be paid to the Water Department at the time of the issuance of the permit: 

(2)  $2,536.00 (two thousand, five hundred and thirty-six dollars) per E.D.U.

 

2.   Any Ordinance or parts of Ordinances inconsistent herewith are hereby repealed.

                 

3.      This Ordinance shall take effect following final adoption and publication pursuant

“CODE OF THE BOROUGH OF ENGLISHTOWN, NEW JERSEY”

 

Be It Ordained by the Mayor and Council of the Borough of Englishtown, County of Monmouth and State of New Jersey, that the following section of Chapter 2.106 be amended and supplemented as follows:

1.   Article I – Installation and Use, Section 2.106.2 (Connection of Future Structures), Subsection B of the “Code of the Borough of Englishtown, New Jersey” is hereby amended and supplemented to read as follows:

 

B. The owner of every residential house, building and/or structure hereafter constructed, modified or improved in the Borough of Englishtown, which may be occupied or used by human beings, shall, if connection with the sewer system of the Borough of Englishtown is made on or after August 8, 2007, be charged a connection fee of $893.00 (eight hundred ninety-three) dollars

 

2.      All ordinances and parts of ordinances inconsistent herewith are hereby repealed.

 

3.      This ordinance shall take effect upon final adoption and publication pursuant to law.

ORDINANCE NO. 2007-13

 

ORDINANCE AMENDING

CHAPTER 2.55, ENTITLED “ANIMAL CONTROL REGULATIONS”

OF THE CODE OF THE BOROUGH OF ENGLISHTOWN

 

WHEREAS, the Borough Council of the Borough of Englishtown has determined that there are occasions where pet waste on non-public property serves as a threat to the health and safety of residents of the Borough of Englishtown; and

 

WHEREAS, the Borough is desirous of protecting the safety and welfare of the community by controlling situations of offensive pet waste;

 

NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Englishtown that Chapter 2.55 of the Code of the Borough of Englishtown is hereby amended as follows:

 

I. The following shall be added to Section 2.55.13.03:

 

All pet owners and keepers are required to immediately and properly dispose of their pet’s solid waste deposited on property owned or possessed by that person if such waste is located within ten feet of another property or public access way, such as a sidewalk.

 

All pet owners and keepers are required to dispose of any animal waste deposited on property owned or possessed by that person regardless of the location within that property in a timely fashion so as to insure that it does not create an unsanitary condition as to odors affecting other properties. Should an odor condition prevail from that waste for a period of more than 48 hours, it shall be presumed that the waste was not removed in a timely fashion.

 

BE IT FURTHER ORDAINED THAT this Ordinance shall take effect upon passage and publication in accordance with applicable law.

Resolution No. 2007-129

 

Resolution Appointing Peter S. Cooke, Jr. to the Position of

Sergeant in the Police Department of the Borough of Englishtown

                                               

Whereas, the Borough Council of Englishtown, having previously created a second position within the Police Department for the rank of Sergeant; and

 

Whereas, the Borough has determined that it is in the best interests of the Police Department and the Borough to promote an individual to that position from within the current ranks of Police Department personnel; and

 

Whereas, the Borough has conducted a review of existing personnel in conjunction with the Chief of Police of the Police Department of the Borough of Englishtown and has determined that the most qualified person for this position is current officer Peter S. Cooke, Jr.; and

 

Whereas, the Borough is desirous of appointing Peter S. Cooke, Jr. to the position of Sergeant effective July 25, 2007, with a one year probationary period, in accordance with Borough and Police Department policy and has determined that this appointment is consistent with the Contract with the Police Benevolent Association Local 166.

 

            NOW THEREFORE BE IT RESOLVED, by the Borough Council of Englishtown that Peter S. Cooke Jr. is hereby promoted to the position of Sergeant in the Police Department of the Borough of Englishtown to be paid in accordance with the Contract between the Borough of Englishtown and the Police Benevolent Association Local 166 at a base salary of $59,624.00 per annum.

 

            BE IT FURTHER RESOLVED that a certified copy of this resolution shall be distributed to the Chief of Police, the Borough Administrator and Sergeant Cooke.

Resolution No. 2007-130

 

2006 Audit of the Borough of Englishtown

Division of Local Government

 

            Whereas, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and

 

            Whereas, the Annual Report of Audit for the year 2006 has been filed by a Registered Municipal Accountant with the Acting Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and

 

            Whereas, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and

 

            Whereas, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations”; and

 

            Whereas, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations”, as evidenced by the group affidavit form of the governing body attached hereto; and

 

            Whereas, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and

 

            Whereas, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of the New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and

 

            Whereas, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:

 

            R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.

            Now Therefore Be It Resolved, that the governing body of the Borough of Englishtown, hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Borough of Englishtown

Resolution No. 2007-131

 

Opposition to the Sale of State Assets

 

            Whereas, a great number of residents use New Jersey’s toll roads to commute to work on a daily basis and many businesses rely on these major transportation arteries to receive and deliver goods and services and

 

            Whereas, New Jersey’s high cost of living and even higher property taxes have placed such a financial strain on taxpayers and business owners that the state is fast becoming an unaffordable place for them to live and work, and

 

            Whereas, Governor Jon S. Corzine and key legislative leaders are pushing a plan to sell New Jersey assets, starting most likely with the toll revenues generated by the New Jersey Turnpike, Garden State Parkway and Atlantic City Expressway, and

 

            Whereas, language was included in the FY 2008 state budget authorizing the Corzine Administration to spend whatever amount of money it deems necessary to prepare for the lease or monetization of state assets, and

 

            Whereas, the Corzine Administration has publicly stated that specific details of the asset sale until not be disclosed to the public until after the November legislative elections, but it has confirmed the revenue it would produce is needed to balance a projected multi-billion-dollar hole in the FY 2009 state budget, and

 

            Whereas, the Corzine Administration and key legislative leaders are examining the possibility of creating a new public agency that would sell billions of dollars of bonds to private investors backed by future toll road revenue, and

 

            Whereas, administration and legislative officials have confirmed annual toll increases, over several decades, will be necessary to make the bonds attractive to private investors, and

 

            Whereas, in the past six years, state debt has more than doubled, from $15 billion to $37 billion, and the asset sale would instantly add billions of dollars to the debt load and intensify the pressure to raise taxes, and

 

            Whereas, experience has shown that whenever tolls are increased, more trucks choose to use state and local roadways to save the expensive, and

 

            Whereas, increased truck traffic will accelerate the deterioration of state and local roadways, result in more traffic congestion and create a safety hazard to motorists and pedestrians alike, now therefore be it

 

            Now Therefore Be It Resolved, that the Borough of Englishtown opposes any plan to sell, lease or monetize state assets, particularly state toll roads and the revenue they produce, because it will make New Jersey more unaffordable for residents and business owners, jeopardize the fiscal integrity of the state, and make our roads less safe.

 

Be It Further Resolved, a certified copy of this resolution shall be sent to Governor Jon S. Corzine, Assembly Speaker Joseph Roberts, Senate President Richard J. Codey, Senate Minority Leader Leonard Lance, Assembly Minority Leader Alex DeCroce and all state legislators representing our legislative district.

Resolution No. 2007-132

 

Authorizing the use of N.I.M.S.

(National Incident Management System)

 

            Whereas, in Homeland Security Presidential Directive (HSPD) 5, the President directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS), which would provide a consistent nationwide approach for Federal, State, and Local governments to work together more effectively and efficiently to prevent, prepare for, respond to, and recover from domestic incidents, regardless of cause, size or complexity; and

 

            Whereas, the 9-11Commission recommended adoption of a standardized incident Command System; and

 

            Whereas, it is necessary that all Federal, State, and Local emergency management agencies and other public safety agencies coordinate their efforts to effectively and efficiently provide the highest levels of incident management; and

 

            Whereas, to facilitate the most efficient and effective incident management it is critical that Federal, State, and Local organizations utilize standard terminology, standardized organizational structures, uniform personnel qualifications standards, uniform standards for planning, training, and exercising, comprehensive resource management, and designated incident facilities during emergencies or disasters; and

 

            Whereas, the NIMS standardized procedures for managing personnel, communications, facilities, and resources will improve the ability to utilize State and Federal funding to enhance County and Local agency readiness, maintain first responder safety, and streamline incident management processes; and

 

            Whereas, the Incident Command System components of NIMS are already an integral part of various incident management activities throughout the State, County, and Local Municipalities, including all public safety and emergency response organizations training programs; and

 

            Whereas, over fifty Federal grant programs mandate that NIMS be adopted as a prerequisite for obtaining these grants;

 

            Now Therefore, Be It Resolved, by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that the National Incident Management System (NIMS) be utilized for all incident management in the Borough of Englishtown;

 

            Be It Further Resolved, that a certified copy of this resolution shall be distributed to the Officer of Emergency Management and Chief of Police.

            Whereas, after due consideration of the said requisitions, the Mayor and Council have approved processing of same.

            Whereas, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and

 

            Whereas, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.

 

            Now, therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:

 

            1.   The said approved vouchers amounting to the sum of $418,337.65

                   are hereby authorized to be paid on July 25, 2007.

Discussion Item - Proposed Moratorium Ordinance

 

Mayor Reynolds explains that we want to have a moratorium ordinance for five (5) years especially on roads that have been paved recently and asks if there are any exceptions to the rule or if there is a minimum or maximum you can put a moratorium on.

 

Stuart Moskovitz, Borough Attorney states there is a provision for emergent matters.  Also if someone should come before Council and ask for an exception and Council feels there is a valid reason that is in Ordinance also.

Mayor Reynolds thanks Chief Niziolek for coming to the meeting this evening to clarify last meetings discussion on which side of the street parking and opens the floor for comments and questions.
