Mayor Reynolds states for the record C/Palmieri had called to say she couldn’t attend tonight’s meeting.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and Home News and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.

C/Rucker states I would like to commend the DPW for another successful summer season and now they are busy getting ready for the fall pick up and winter maintenance of the roads. Also, a special comment on the effort Kurt Knapp and Rob Rosche-Ebbe put in this past week in assisting the Recreation Committee in preparing for the Fall Festival. I hope everyone comes out to enjoy it and you can see our new restroom in the park.

C/Carr states I would like to publicly thank Pete Cooke and Rich Settele, who responded to a 911 call to my house this week. They were at my house before I hung up the phone. Also, Marion Masnick called me today to see if you were going to respond to a letter that went out on September 3rd asking for a Proclamation for Freeholder Narozanick.
Julie Martin, Municipal Clerk responds I photocopied it for Mayor and Council and I was going to read it into correspondence this evening. We received it on the 15th, which was the day after the last meeting.
C/Carr continues, I just have one last thing, was there anyone who went to the Governor’s Conference on Housing in Atlantic City yesterday, representing Englishtown?
Response was no.
C/Carr states I had a phone call today at work and it was overheard at the Governor’s Conference that Englishtown was planning on making a redevelopment zone designating a redevelopment zone for the downtown of Englishtown and they were calling to ask me if we were and where it was going to be, so I’m asking you are we and if so where is it going to be? I asked Mrs. Stipple because she is on the planning/zoning board and she said they have not spoken about it so I’m assuming it came from here.

Mayor Reynolds states I had no conversation with anyone.
C/Gallagher states or it could be incorrect.
C/Carr states it could be incorrect that’s why I’m asking.
C/Simon states the police activity report from 9/12 – 9/25, there were 384 calls and 126 motor vehicle stops. Also I received a letter from Councilman Michael Tobin of the Freehold Borough, thanking our police department for the great work the officers did. His wife had a blowout and our officers stayed with her until he arrived and called AAA.
Julie Martin, Municipal Clerk states as C/Carr just mentioned, on September 15th a letter was received from Marion Masnick, the secretary to Freeholder Narozanick. Centrastate Healthcare Foundation is honoring Freeholder Narozanick for his forty years of friendship and support on Saturday, November 12th. As secretary to Freeholder Narozanick, Marion Masnick is requesting that a Proclamation be prepared by our municipality commemorating this event and to be presented to Freeholder Narozanick that evening. I would like consensus of Council to get the Proclamation prepared for Freeholder Narozanick.

Julie Martin continues, on August 31st correspondence was received from the Office of the County Prosecutor, County of Monmouth congratulating Chief John Niziolek and the members of the Englishtown Police Department for the excellent work they did in the case of the State versus $1,608.00 in United States currency. The Borough received a check in the amount of $500.00; which was the proceeds for the confiscation of property.
Lastly, as C/Rucker stated earlier, the Fall Festival is this coming Saturday, October 1st between the hours of 1 and 5 p.m.
Mayor Reynolds opened the floor to the public for discussion limited to agenda items only.
Kevin Bosies, Main Street, asks regarding Resolution No. 2005-143, could you tell me what the assignments are?
John Bennett, Borough Attorney responds, they are going to be tabled tonight because we have to post a notice prior to taking action on them. However the two tax liens that were sold that the Borough acquired sometime in 1991, someone has come forward and offered to redeem them at full value including full interest. We would then assign the liens to them.
Kevin Bosies asks on the bill list, Maser Consulting Invoices, there was a $4500.00 charge for Village Center, is that coming out of escrow?
Julie Martin, Municipal Clerk states it is for inspections and is coming out of the trust fund.
C/Gallagher states that is for the new shopping center across from where Quick Check will be.

BOROUGH OF ENGLISHTOWN Public Hearing & Adoption
ORDINANCE NO. 2005-10
AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 1.10,
“CHIEF FINANCIAL OFFICER”, OF THE “CODE OF THE BOROUGH
OF ENGLISHTOWN, NEW JERSEY”, ESTABLISHING THE POSITION OF DEPUTY CHIEF FINANCIAL OFFICER.
WHEREAS, the Mayor and Borough Council of the Borough of Englishtown believe that it is in the best interests of the Borough to establish the position of Deputy Chief Financial Officer within the Borough; and
WHEREAS, the establishment of such position will better enable the Borough to operate more efficiently and effectively.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED by Borough Council of the Borough of Englishtown, in the County of Monmouth and State of New Jersey, as follows:
1. That Chapter 1.10, entitled “Chief Financial Officer”, of the “Code of the Borough of Englishtown, New Jersey” is hereby amended and supplemented in order to establish the position of Deputy Chief Financial Officer as follows (additions are underlined):
§1.10.02. Deputy Chief Financial Officer; Establishment; Certification.
There is hereby established the position of Deputy Chief Financial Officer in the Borough of Englishtown, who shall be a Certified Municipal Financial Officer pursuant to N.J.S.A. 40A:9-140.1, et seq., which position shall have such salary and such duties as the governing body, or the Chief Officer of the department of which the Deputy Chief Financial Officer is employed, shall direct. The minimum number of hours each week, which the Deputy Chief Financial Officer must work, shall be established by the Mayor and Borough Council as deemed necessary for the performance of the duties of Deputy Chief Financial Officer. The Deputy Chief Financial Officer may hold another office or position in the Borough of Englishtown, and if such is the case shall receive the salary of that office or position; otherwise, the Deputy Chief Financial Officer shall receive the salary and compensation as provided in Chapter 37 of the “Code of the Borough of Englishtown, New Jersey”. Nothing contained herein shall prevent the person who is serving as Deputy Chief Financial Officer while at the same time holding another office or position with the Borough for which he or she is receiving the compensation of that latter office, to receive a stipend or other compensation determined by the Mayor and Borough Council for performing the additional duties of Deputy Chief Financial Officer.
2. That the provisions of this Ordinance shall be severable. In the event that any portion of this Ordinance is found to be invalid for any reason by any Court of competent jurisdiction, such judgment shall be limited in its effect only to that portion of the Ordinance actually adjudged to be invalid and shall not be deemed to affect the operation of any other portion thereof, which shall remain in full force and effect.
3. That all other Ordinances or parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistencies.
4. That this Ordinance shall take effect on final passage and publication in accordance with the law.

John Bennett, Borough Attorney states our current administrator has certification and the Resolution later tonight would be appointing her to be the Deputy CFO.
Kevin Bosies, does that mean that our CFO is resigning?
John Bennett responds, no our CFO is still our CFO.
Kevin Bosies, is the deputy CFO going to do part of his job?
John Bennett responds yes.
Kevin Bosies, is the CFO taking a cut in pay?
John Bennett responds no. We’re in litigation with our CFO.
Kevin Bosies, is this in connection with that?
John Bennett responds yes.
Paula Kuchinski, does this mean we will end up with 1 ½ CFO’s when this is all over?
John Bennett responds, you can only have one CFO.
Paula Kuchinski, that’s what I thought so why do we now have 1 ½?
John Bennett states no we only have one. This is a position for a Deputy CFO who is authorized to do the services of a CFO in the absence of a CFO. She is here during the day and would have the authority to execute documents. An assistant CFO does not have the authority that a Deputy has.
Paula Kuchinski, and they are both on Englishtown’s payroll now.
John Bennett responds that is correct.

ORDINANCE NO. 2005-11
AN ORDINANCE AMENDING AND SUPPLEMENTING
THE ORDINANCE ESTABLISHING THE SALARIES OF
CERTAIN OFFICERS AND EMPLOYEES OF
THE BOROUGH OF ENGLISHTOWN FOR THE YEAR 2005.
WHEREAS, the Mayor and Borough Council of the Borough of Englishtown wish to amend and supplement the Ordinance establishing the salaries of certain officers and employees of the Borough of Englishtown for the year 2005 as provided herein.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED by the Borough Council of the Borough of Englishtown, in the County of Monmouth and State of New Jersey, as follows:
1. That the Ordinance establishing the salaries of the officers and employees of the Borough of Englishtown for the year 2005 is hereby amended and supplemented in order to establish the following positions and salaries and the Borough Chief Financial Officer is hereby authorized to transfer such sums of money from such payroll from the time as directed by the salary resolution of the Governing Body:

Whereas, N.J.S.A. 54:5-113 authorizes assignment by a municipality of tax sale certificates for the full amount of the certificate, including all subsequent municipal taxes and other municipal charges; and
Whereas, Culmac Investors have presented an offer to purchase, by assignment, Certificate of Sale # 5-91 which was issued to be Borough of Englishtown at a tax sale held in November 1991 on Block 2, Lot 23.05 LaSatta Avenue, Englishtown, NJ, and assessed to John Monetti Builders in the full amount of the certificate, including all subsequent municipal taxes and other municipal charges as determined by the Borough Tax Collector.
Now, Therefore, Be It Resolved, that the Borough of Englishtown hereby authorizes the Mayor and Municipal Clerk to execute the necessary assignment document to effect assignment of the above-referenced Certificate of Sale.
Be It Further Resolved, that a copy of this resolution be forwarded to the Tax Collector, The Borough Chief Financial Officer and the Borough Administrator.

Whereas, the Battleground Historical Society has applied to the Governing Body of the Borough of Englishtown for a raffle license for November 19, 2005; and
Whereas, the Battleground Historical Society has paid all the proper fees to the Borough of Englishtown and submitted the proper fees to be forwarded to the Legalized Games of Chance Control Commission; and
Whereas, the Mayor and Governing Body of the Borough of Englishtown finds that the Battleground Historical Society is a qualified applicant and the members of the Battleground Historical Society are designated to conduct games of chance and are of good moral character and said members have never been convicted of a crime to the best of the Council’s knowledge; and
Whereas, said games are to be conducted by the rules set forth by the Legalized Games of Chance Control Commission and the entire net proceeds are to be disposed of for a purpose permitted by the Raffle Licensing Law Act of 1954; and
Whereas, there is satisfactory proof that the Battleground Historical Society will not make payment for the conducting of the game or assisting therein, except to the extent allowed by law; and
Whereas, The Battleground Historical Society has stated that any rental to be paid for raffle equipment does conform to the schedule of authorized rentals prescribed by the rules of the Control Commission and the raffles equipment lessor, should there be one, has been approved by the Control Commission; and
Now, Therefore, Be It Resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that Raffle Application No. RA2005-01 for the Battleground Historical Society be approved as required by N.J.A.C. 13:47-4.11 and forwarded to the Legal Games of Chance Control Commission as prescribed by N.J.A.C. 13:47-4.3 (b); and
Be It Further Resolved, that a copy of Raffle License RA2005-01 be forwarded by the Municipal Clerk to the Legalized Games of Chance Control Commission for their review and determination; and
Be It Further Resolved, on the fifteenth day after Raffle Application No. RA2004-01 has been forwarded to the Legalized Games of Chance Control Commission with no objections received, Raffle License No. RA2005-01 may be issued to the Battleground Historical Society and copies of said license shall be distributed to the Licensee, the Municipal Clerk, and the Borough of Englishtown Police Department.

Water/Sewer Clerk/Deputy Tax Collector
WHEREAS, there is currently the position of Water/Sewer Clerk/Deputy Tax Collector within the Borough of Englishtown; and
WHEREAS, the duties of the Deputy Tax Collector will increase to assist the Tax Collector; and
WHEREAS, it is the recommendation of the Administration/Finance/Personnel Committee to adjust the salary for the position of Water/Sewer Clerk/Deputy Tax Collection.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that:
1. Regina Frangipane’s salary be amended effective September 29, 2005 to the sum of $28,250.00 while performing the duties of Deputy Tax Collector.

Whereas, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.
Now, therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:
1. The said approved vouchers amounting to the sum of $375,829.86 be and
the same are hereby authorized to be paid on September 28, 2005.
2. The Borough Clerk be and is hereby directed to list on the page in the

3. That said employee shall be part-time, paid $9,000.00 per annum, payable bi-
weekly in accordance with the Borough salary ordinance.

Mayor Reynolds opened the floor to the public for discussion on anything they wish to bring to the attention of the governing body.
Pete Cooke, 12 Wood Avenue, first thing I would like to thank the DPW for allowing us use of one of their pick up trucks. This week we had a second police car go down and we were down to one police car and we had road jobs going on. The use of their truck was appreciated so our officers weren’t left on the road job with no car. Second, there was a rumor going around that after the council approved the other police car getting fixed that the Chief sat on that for a week. I wanted to correct that; he took care of that right away. Englishtown Automotive took a week to come and get the car because he had to order parts for it.
Lastly, the PBA representative couldn’t be here today, so I’m speaking on his behalf in reference to the special duty at Gary Michael’s.
Mayor Reynolds responded we will be speaking about that in Executive Session.
Paula Kuchinski states I just saw in the news tonight that in Randolph, New Jersey they have a metro counter, which is the black wires that go across the street to see how many cars speed by. The machine costs roughly $1,000.00 and I wanted to know if Englishtown could purchase one. My street has become nothing but a speed trap. I don’t know the particulars but I think it should be looked into and you would find it would be very useful and would pay for itself in no time.
Kevin Bosies states I recently learned that a town in Bergen County, their police chief retired earlier this year and because of his accrued vacation and unused sick days, the homeowners are facing an average assessment of $300.00 for the next three years to pay for his accrued salary. Do we allow carry over of unused vacation and sick days?
C/Carr responds only $2500.00 can be carried over.
C/Gallagher responds if they retire they can only get up to $2500.00. We know we can’t afford to do what big towns do.
Kevin Bosies asks and that’s for all Borough employees?
C/Gallagher replies no. Borough employees don’t get anything, they lose their sick time after the end of the year.
Julie Martin, Municipal Clerk responds Borough employees are allowed to carry unused vacation days over to the next year and it has to be used within six months. Sick time is “use it or lose it”.

Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and
Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of personnel, pending and anticipated litigation; and
Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour, 4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.
