The meeting was called to order by Mayor Reynolds at 7:31 p.m.

Also present were Julie Martin, Municipal Clerk and Lynn Tillman, Deputy Municipal Clerk. John Bennett, Borough Attorney arrived at 7:35 p.m.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and Home News and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.
There was a moment of silence and salute to the flag.
C/Rucker states nothing at this time.
C/Palmieri states there will be a Recreation meeting Saturday, December 4th at 10:00 a.m. Following the meeting, at 12:00 p.m. will be the Trim the Tree craft at Borough Hall.
C/Gallagher states nothing at this time.
C/Soden states the police activity report from 11/8 – 11/19, there was a total of 401 calls, 61 motor vehicle stops and 31 tickets were issued. The new police car has been lettered and we are still waiting on the light bar.
C/D’Agostino states nothing at this time.
C/Simon states nothing at this time.
Julie Martin, Municipal Clerk states just a reminder that this Thursday’s recycling will be picked up on Friday, because of Thanksgiving.
Mayor Reynolds opened the floor to the public for discussion limited to agenda items only.
Jayne Carr, Main Street regarding Resolution No. 2004-184, why was there a change in the order for street sweeping.
Julie Martin, Municipal Clerk responds there is an additional charge of $28.00, which is an increase in the fuel charge.
There being no further questions or comments from the public, a motion to close the public portion was offered by C/Soden, seconded by C/Simon. Passed unanimously.

Whereas, the Borough of Englishtown Council requires that purchases and services over $800.00 or more be pre-approved by the Governing Body except in the case of imminent emergency situation; and

Whereas, the amount of overpayments and balances are less than $5.00 and are outstanding from 2002/2003; and
Whereas, it is requested by the Chief Financial Officer and the Tax Collector that the overpayments and balances listed above be cancelled.
Now, Therefore, Be It Resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that it hereby authorizes the cancellation of the above mentioned tax overpayments and balances.
Be It Further Resolved that a certified true copy of this Resolution be forwarded to the Chief Financial Officer and the Tax Collector.

Resolution No. 2004-184
Whereas, the Borough of Englishtown previously authorized (by Resolution 2004-162) Ocean Power Sweeping, for fuel surcharge on street sweeping; and
Whereas, the following change has been submitted:
Additional Charge of $28.00
Whereas, the amount of the service will be increased by the sum of Twenty-eight Dollars ($28.00); and
Whereas, the Public Buildings and Grounds Committee has reviewed and approved the changes; and
Whereas, the purchase total including this Change Order will be Eight Hundred Twenty-eight ($828.00).
Now, Therefore, Be It Resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that it hereby authorizes Change Order No. l.
Be It Further Resolved that a certified true copy of this resolution be forwarded to the Borough’s Chief Financial Officer and Borough Engineer.

Resolution No. 2004-185
Appropriation Transfer
Whereas, N.J.S.A. 40A: 4-58 provides that during the last 2 months of the fiscal year, to expend for any of the
purposes specified in the budget an amount in excess of the respective sums appropriated therefore and there shall be an
excess in any appropriation over and above the amount deemed to be necessary to fulfill the purpose of such appropriation.
Now, Therefore, Be It Resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that the transfers in the amount of $21,000.00 be made in the 2004 budget as attached.

Resolution of the Borough of Englishtown,
County of Monmouth, State of New Jersey
Authorizing the Payment of Borough Bills
Whereas, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and
Whereas, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.
Now, therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:
1. The said approved vouchers amounting to the sum of $394,911.06 be and
the same are hereby authorized to be paid on November 22, 2004.
2. The Borough Clerk be and is hereby directed to list on the page in the
Minutes Book following the minutes of this meeting all of the said vouchers hereby authorized to be paid.

Mayor Reynolds opened the floor to the public for discussion on anything they wish to bring to the attention of the governing body.
Jayne Carr, Main Street states last meeting you had a long executive session to discuss personnel however there was no one here from personnel. Are you allowed to discuss personnel without that person present?
John Bennett, Borough Attorney responds yes you are. We did not discuss a specific individual last meeting. We discussed something that impacts all the employees.
There being no further questions or comments from the public, a motion to close the public portion was offered by C/Soden, seconded by C/Simon. Passed unanimously.
Executive Session
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and
Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of personnel, and
Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour, 4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.
