Also present were Julie Martin, Municipal Clerk, Lynn Tillman, Deputy Municipal Clerk, and John O. Bennett, Borough Attorney.
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-6 notification of this meeting has been (1) Published in the Asbury Park Press and Home News and the News Transcript the Official Newspapers of the Borough, (2) Posted to the Public at Borough Hall, (3) Copy has been filed with the Municipal Clerk, (4) Copy of this agenda and the Sunshine Statement has been filed with the Mayor and Council. Thus this meeting tonight is deemed in compliance with the Open Public Meetings Act.
There was a moment of silence and salute to the flag.
There being no corrections, deletions, or additions, a motion to approve the Minutes of September 8, 2004 was offered by C/Gallagher, seconded by C/Simon. Passed on the following roll call:

C/Rucker states nothing at this time.
C/Palmieri states the Halloween Party on October 29th at the Firehouse was a big success. I want to thank our committee members, Christine Robbins, Liz Canario, Cindy & Chanin Robilotti & Sue Benedict and also our volunteers, Jayne Gallagher, Ann Marie Lutz & Julie Martin for helping out. I also want to thank the Englishtown Fire Dept. Explorers that helped, Joey Frangipane, Eric Knapp, Jason Kirkland & Billy Freauh. It truly was a wonderful event and I am looking forward to next year’s party. Secondly, on December 4th at 12:00, Borough Hall the Recreation Committee will be having a trim the tree craft. All are welcome.
C/Gallagher states today C/Palmieri, Julie Martin, Municipal Clerk and myself met with the Monmouth County Board of Taxation. A letter was sent to the Borough Tax Assessor a week ago to attend this meeting, which was in regard to the Borough not having a revaluation in 14 years. I left information out for the public on what the criteria is for a revaluation. I think the best we will be able to do, is put it off for a couple years if possible, based on the argument that within 2 years the Borough will be completely built out. They will notify us of their decision in three weeks. If we are ordered to revalue, the Borough would have to pay for it; bond for it and we can pay that back over a five-year period.
C/D’Agostino states nothing at this time.
C/Simon states the police activity report from 10/25 – 11/7; there were 518 calls and 95 motor vehicle stops. Also, there was a press release on our Police Department. I want to thank the police officers for doing a great job.
Julie Martin, Municipal Clerk states we received a thank you card from Kurt Knapp, one of our Public Works Employees, for the flowers that were sent for his mother who recently passed away. Secondly, last meeting I gave council the proposed 2005 meeting dates and I need council’s approval on these dates. The reorganization meeting will be on Tuesday, January 4th and the Budget Workshop will be on Saturday, January 22nd at 8:30 a.m. Just to let everyone know, the next council meeting will be on Monday, November 22, 2004 as opposed to Wednesday, November 24th because it is the eve of Thanksgiving. Also, the Recreation Department received correspondence from the N.J. Devil’s thanking them for inviting them to the Halloween Party and they look forward to working with Englishtown Borough again. Also, C/Soden sends his apologies for not being able to make tonight’s council meeting.
Mayor Reynolds opened the floor to the public for discussion limited to agenda items only.

Resolution No. 2004-177
RESOLUTION AUTHORIZING THE EXECUTION
OF AN INTER-LOCAL SERVICES AGREEMENT WITH
THE COUNTY OF MONMOUTH FOR THE PROVISION OF
DISPATCHING POLICE, FIRE AND EMERGENCY MEDICAL SERVICES.
WHEREAS, the Borough of Englishtown is desirous of having the County of Monmouth, under the auspices of the Office of the Sheriff, provide dispatch services for the Borough’s Police, Fire and Emergency Medical Services; and
WHEREAS, the County of Monmouth has agreed to provide said dispatch services to the Borough; and
WHEREAS, the Borough and the County desire to enter into an Inter-local Services Agreement for the provision of said services, as more particularly described in the attached Agreement, which is incorporated herein; and
WHEREAS, pursuant to the “Inter-local Services Act”, N.J.S.A. 40:8A-1, et seq., the Borough is authorized to enter into an agreement with any other local unit or units for the joint provision within their several jurisdictions of any service which any party to the agreement is empowered to render within its own jurisdiction; and
WHEREAS, the proposed agreement for the provision of the aforesaid services is on file in the Borough Clerk’s Office in accordance with the provisions of N.J.S.A. 40:8A-4.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED by the Borough Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, that the Mayor is hereby authorized to execute and the Municipal Clerk to attest the attached Inter-local Services Agreement between the Borough of Englishtown and the County of Monmouth for the provision of the aforementioned emergency dispatch services.
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be provided to each of the following:

Whereas, the Borough of Englishtown Tax Collector has reported that the following Tax Sale Certificate has been sold to American Tax Funding, P.O. Box 862658, Orlando, FL 32886-2658:
Redemption in the amount of $10,727.64 for:

Whereas, the above mentioned certificate has been paid and American Tax Funding, P.O. Box 862658, Orlando, FL 32886-2658 is entitled to a refund of $10,727.64.
Now, Therefore, Be It Resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey that it hereby authorizes payment in the amount of $10,727.64 to American Tax Funding, P.O. Box 862658, Orlando, FL 32886-2658.

Resolution of the Borough of Englishtown,

Authorizing the Payment of Borough Bills
Whereas, the Mayor and Council have carefully examined all vouchers presented to the Borough for the payment of claims; and
Whereas, after due consideration of the said vouchers, the Mayor and Council have approved payment of same.
Now, therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, as follows:
1. The said approved vouchers amounting to the sum of $224,042.48 be and
the same are hereby authorized to be paid on November 10, 2004.
2. The Borough Clerk be and is hereby directed to list on the page in the Minutes Book following the minutes of this meeting all of the said vouchers hereby authorized to be paid.

Mayor Reynolds opened the floor to the public for discussion of anything they wish to bring to the attention of the governing body.
Jayne Carr, Main Street states I distributed a letter two weeks ago and asked for a response as far as if this letter represented C/Simon’s own opinion or council’s opinion. I have heard no response.
C/Simon answers that was my own opinion and I was not representing the Council.
There being no further questions or comments from the public, a motion to close the public portion was offered by C/Simon, seconded by C/D’Agostino. Passed unanimously.
Executive Session
Mayor Reynolds stated pursuant to N.J.S.A. 10 4-12B be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey as follows whereas N.J.S.A. 10 4-12B of the Open Public Meetings Act of the State of New Jersey permits exclusion of the public from those portions of the meetings in which matters authorized to be discussed in Executive Session under the cited statute will be reviewed and discussed; and
Whereas, the Governing Body concludes that the public must be excluded from the discussion of the following matters of personnel, and potential litigation; and
Therefore, be it resolved by the Mayor and Council of the Borough of Englishtown, County of Monmouth, State of New Jersey, as follows, 1) Hereby authorizes Executive Session for the purpose of discussing above matters with N.J.S.A. 10 4-12B, 2) Anticipated at this time that the matters to be discussed in Executive Session will be discussed in Public not earlier than the next regular meeting of the Governing Body, 3) It is anticipated that the Executive Session last not longer than one-half hour, 4) There exists the possibility that action may be taken upon conclusion of the Executive Session when the meeting returns to open.
